The appeal is from a judgment quashing the writ of prohibition which challenged the legality of the plaintiffs arrest for a misdemeanor. On February 9, 1966, before Judge William C. Sachtjen who was then sitting as a magistrate, Jack E. DeYoung executed a criminal complaint which charged Otto E. Pflanz, Jr., the present plaintiff, with filing fraudulent Wisconsin income tax returns for the years 1959 through 1963, inclusive, contrary to sec. 71.11 (42), Stats. The complaint stated it was based on personal knowledge of the complainant who made investigations of Pflanzs records. Upon this complaint, an arrest warrant was issued by the magistrate and Pflanz was arrested, brought before County Judge William L. Buenzli the following day and released on a cash bond.
